Terms of Service — Borough Buddies

Short version: Play fair, stay safe, don't do anything illegal. Borough Buddies is free to play. We own the game and its characters. You own your device. By using the App you agree to these terms.

1. Acceptance of Terms

By downloading, installing, or using Borough Buddies (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Who Can Use the App

Borough Buddies is available to players of all ages. However:

Players under 13 who wish to create a cloud-backed account must complete our parental consent flow. See our Privacy Policy for details.
Players under 18 should use the App with parental awareness. We encourage families to play together.
You must not use the App in any jurisdiction where doing so would violate applicable law.

3. The App and License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial entertainment purposes.

You may not:

Copy, modify, distribute, sell, or lease any part of the App
Reverse-engineer or attempt to extract the App's source code
Use the App to develop a competing product
Use automated scripts, bots, or other tools to interact with the App
Spoof your location or otherwise manipulate the game's location-based mechanics

4. Game Content and Buddies

All buddies, characters, names, artwork, animations, sounds, and game content are the original creative work of Borough Buddies and are protected by copyright and other intellectual property laws. All rights reserved.

Your in-game progress (XP, catches, leaderboard rank) does not constitute property. We may adjust, reset, or modify game mechanics, buddy availability, or leaderboards at any time without notice or compensation.

5. User Conduct

You agree to use the App only for lawful purposes. You must not:

Trespass or enter private property while playing
Endanger yourself or others (please look up from your phone when crossing streets!)
Harass, threaten, or harm other players
Attempt to manipulate leaderboards through cheating, exploits, or use of third-party tools
Impersonate another person or entity
Transmit viruses, malware, or any harmful code

We reserve the right to suspend or terminate your access for any violation of these Terms.

6. Safety While Playing

Borough Buddies is a location-based game that encourages you to walk around New York City. Please:

Pay attention to your surroundings at all times
Follow all traffic laws and pedestrian signals
Do not enter restricted areas, construction sites, or private property
Play with a companion, especially children
Be aware of your physical limits

We are not responsible for any injury, loss, or damage that occurs while you are playing the App.

7. Geographic Scope

At launch, Borough Buddies is focused on Manhattan, New York City. Buddy spawns, landmarks, and leaderboards are built around this area. We may expand to additional boroughs and cities in future updates.

8. Availability and Changes

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We may also update these Terms at any time. Material changes will be communicated via the App or our website. Continued use after changes take effect constitutes acceptance of the updated Terms.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it — we worked hard to make it genuinely safe, especially for kids.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BOROUGH BUDDIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED $100 USD.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
